MinistryHub Terms of Service
These Terms of Service (“Terms”) govern access to and use of MinistryHub, a software service operated by Up & At ’Em Design Co. LLC (“MinistryHub,” “we,” “us,” or “our”).
By creating a MinistryHub account, purchasing a subscription, or using the MinistryHub platform, you agree to these Terms on behalf of yourself and, if applicable, the church, ministry, organization, or other entity you represent (“Customer”).
If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
1. MinistryHub
MinistryHub provides software tools designed to help churches and ministries create connection experiences, collect and manage responses, communicate with people, integrate with third-party ministry platforms, and perform related ministry workflows.
Available features may vary based on subscription, product tier, configuration, and the continued development of the MinistryHub platform.
We may improve, modify, add, or remove features over time. We will not intentionally make material changes that substantially eliminate the core functionality of a paid service without reasonable notice when practicable.
2. Accounts
You must be at least 18 years old and legally capable of entering into this agreement to create a MinistryHub customer account.
You are responsible for:
- Providing accurate account information.
- Maintaining the confidentiality and security of your account credentials.
- Controlling who receives administrative access to your organization.
- Activities performed through accounts under your control.
- Promptly notifying us if you believe an account has been compromised.
You may not share credentials in a manner intended to circumvent account or subscription restrictions.
3. Subscriptions and Billing
Certain MinistryHub services require a paid subscription.
Subscription prices, billing intervals, and included features are presented at the time of purchase.
Unless otherwise stated, subscriptions automatically renew at the applicable monthly or annual billing interval until canceled.
Payments are processed by Stripe or another payment processor identified at checkout. MinistryHub does not directly store complete payment-card numbers.
You authorize us and our payment processor to charge the payment method associated with your account for subscription fees, applicable taxes, and other authorized charges.
4. Cancellation and Refunds
You may cancel a subscription through the billing tools provided within MinistryHub or through the associated billing portal.
Unless otherwise stated, cancellation takes effect at the end of the current paid billing period. You may continue using the applicable paid service until that period ends.
Subscription payments are generally non-refundable, including annual subscription payments and partially used billing periods.
We may, at our discretion, provide refunds, credits, or other accommodations in exceptional circumstances. Doing so in one circumstance does not create an obligation to do so in another.
5. Pricing Changes
We may change subscription pricing from time to time.
Pricing changes will apply prospectively and will not retroactively change charges for a billing period that has already been paid.
When a pricing change affects an existing subscription, we will provide reasonable advance notice when required or appropriate.
6. Customer Data
As between MinistryHub and Customer, Customer retains ownership of information, content, records, branding, form responses, contact information, and other data submitted to MinistryHub by or on behalf of Customer (“Customer Data”).
You grant MinistryHub a limited right to host, process, transmit, reproduce, and otherwise use Customer Data only as reasonably necessary to:
- Provide and maintain the service.
- Perform actions requested or configured by Customer.
- Secure and troubleshoot the service.
- Provide support.
- Comply with applicable law.
- Improve the reliability and operation of MinistryHub using appropriately aggregated or de-identified information where practicable.
MinistryHub does not acquire ownership of Customer Data merely because it is stored or processed through the platform.
7. Information About Church Guests, Members, and Other Individuals
MinistryHub allows Customers to collect information from individuals such as church guests, members, volunteers, attendees, and ministry participants.
In general, the Customer determines what information it collects and how that information will be used. MinistryHub processes that information to provide services to the Customer and carry out the Customer’s configured instructions.
Customer is responsible for:
- Determining what information is appropriate to collect.
- Providing any notices required for its forms or ministry activities.
- Obtaining any consent or authorization required by applicable law.
- Using collected information appropriately.
- Responding to individuals regarding the Customer’s use of their information.
MinistryHub is not responsible for a Customer’s independent use of information after it has been collected or transmitted through the service.
8. Children’s Information
MinistryHub is a business service provided to churches and organizations and is not directed primarily to children.
Customers may use MinistryHub in connection with ministries involving minors. The Customer is responsible for determining and satisfying applicable parental-consent, privacy, child-protection, and other legal requirements associated with its collection and use of information about minors.
Customers should not use MinistryHub to collect information from children in a manner prohibited by applicable law.
9. Sensitive Information
Unless a MinistryHub feature expressly supports a particular type of sensitive information, Customers should not use general-purpose MinistryHub forms to collect highly sensitive information such as:
- Passwords or authentication credentials.
- Complete payment-card information.
- Social Security numbers or similar government identification numbers.
- Detailed medical records.
- Financial account credentials.
- Other information requiring specialized legal or security protections.
If MinistryHub introduces features specifically designed for such information, additional terms or safeguards may apply.
10. Data Export and Account Termination
Customer may access and export supported Customer Data while its account is active.
MinistryHub intends to provide reasonable data-portability tools so Customers can retrieve church-owned information without unnecessary vendor lock-in.
Following termination or expiration of an account, Customer may request available Customer Data for up to 30 days, unless a different period is stated in connection with the applicable service.
After that period, MinistryHub may delete Customer Data from active systems.
Some information may remain temporarily in backups, security records, financial records, system logs, or other records retained for legitimate operational, legal, fraud-prevention, accounting, or compliance purposes. Such information may be deleted according to our normal retention cycles.
Customers are responsible for exporting information they wish to retain before the applicable retention period expires.
11. Third-Party Services and Integrations
MinistryHub may integrate with or rely upon third-party services, including services for payment processing, email delivery, authentication, hosting, ministry management, and related functionality.
Examples may include Stripe, Planning Center, Resend, Google, and other providers.
When Customer connects a third-party service, Customer authorizes MinistryHub to transmit, receive, and process information with that service as necessary to perform Customer’s configured actions.
Customer’s use of third-party services may also be governed by that provider’s terms and privacy practices.
We are not responsible for outages, policy changes, discontinued APIs, data practices, or other actions of independent third-party providers, although we will make reasonable efforts to maintain supported integrations.
12. Planning Center and Similar Integrations
When Customer connects MinistryHub to Planning Center or another ministry-management system, Customer authorizes MinistryHub to access and transmit information according to the permissions granted and the configurations selected by Customer.
Customer remains responsible for its account with the third-party provider and for determining what information should be synchronized.
13. Communications
MinistryHub may enable Customers to send transactional or ministry-related communications.
Customer is responsible for the content of communications it initiates and for complying with applicable communication, privacy, anti-spam, and consent requirements.
Customers may not use MinistryHub to send spam, deceptive messages, unlawful solicitations, or abusive communications.
MinistryHub may also send service-related communications to Customer administrators regarding accounts, security, billing, service changes, and other operational matters.
14. Acceptable Use
You may not use MinistryHub to:
- Violate applicable law.
- Infringe the rights of others.
- Distribute malware or malicious code.
- Attempt unauthorized access to systems or accounts.
- Interfere with the security or operation of MinistryHub.
- Conduct fraudulent or deceptive activity.
- Send spam or abusive communications.
- Collect information you do not have a lawful right to collect.
- Reverse engineer the service except where applicable law expressly permits it.
- Resell or sublicense access to MinistryHub unless we have authorized it.
We may restrict or suspend access when reasonably necessary to protect Customers, individuals, MinistryHub, third parties, or the security and integrity of the service.
15. MinistryHub Intellectual Property
MinistryHub and its software, interface, designs, branding, documentation, underlying technology, and other materials provided by us are owned by Up & At ’Em Design Co. LLC or its licensors and are protected by applicable intellectual-property laws.
These Terms do not transfer ownership of MinistryHub to Customer.
During an active subscription, we grant Customer a limited, non-exclusive, non-transferable right to use the applicable MinistryHub services for its internal organizational purposes in accordance with these Terms.
Customer retains ownership of its own logos, branding, content, and Customer Data.
16. Feedback
If you voluntarily provide suggestions, ideas, or feedback regarding MinistryHub, you permit us to use that feedback to improve or develop the service without compensation or obligation to you.
This does not give us ownership of Customer Data or Customer’s proprietary ministry content.
17. Service Availability
We work to provide a reliable service but cannot guarantee that MinistryHub will always be uninterrupted, error-free, or available.
Service may occasionally be unavailable because of maintenance, upgrades, internet failures, third-party providers, security events, circumstances outside our reasonable control, or other operational issues.
We may perform maintenance and make updates as reasonably necessary to operate and improve the platform.
18. Suspension and Termination
Customer may stop using MinistryHub and cancel its subscription as provided in these Terms.
We may suspend or terminate access if Customer:
- Materially violates these Terms.
- Fails to pay amounts due.
- Uses the service unlawfully or abusively.
- Creates a material security or operational risk.
- Engages in fraudulent activity.
When reasonable under the circumstances, we will attempt to provide notice and an opportunity to resolve the issue before termination.
19. Disclaimer of Warranties
To the fullest extent permitted by law, MinistryHub is provided on an “as is” and “as available” basis.
We disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Up & At ’Em Design Co. LLC and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, or business opportunities arising from or relating to MinistryHub.
To the fullest extent permitted by law, our aggregate liability arising from or relating to the service or these Terms will not exceed the amount Customer paid to MinistryHub during the 12 months immediately preceding the event giving rise to the claim.
These limitations do not apply where applicable law prohibits such limitation.
21. Indemnification
To the extent permitted by law, Customer agrees to indemnify and hold harmless Up & At ‘Em Design Co. LLC and its owners, employees, contractors, and affiliates from third-party claims, damages, liabilities, and reasonable costs arising from Customer’s unlawful use of MinistryHub, Customer’s content or data-collection practices, or Customer’s material violation of these Terms.
22. Changes to These Terms
We may update these Terms as MinistryHub evolves or as legal, regulatory, security, or operational requirements change.
If a change is material, we will provide reasonable notice through the service, by email, or through another appropriate method.
Continued use of MinistryHub after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
23. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
Any dispute arising from these Terms or MinistryHub will be brought in a court of competent jurisdiction located in Arizona, unless applicable law requires otherwise.
